One Milwaukee Federal Judge has recused himself from cases which elevate street crime to Federal Offenses.

His recusal was triggered by a gun possession prosecution.

Is it possible the National Rifle Association’s insistence on enforcing existing Gun Control laws (rather than insist the Constitution be honored and criminals be convicted of criminal behavior) has had the unintended consequence of prison overcrowding?

The bad news? His is not necessarily a principled Constitutional stance, but more a pragmatic refusal to fill Federal Prisons with petty criminals so prosecutors can pad their resumes.

Just as pilots say any landing you leave in one piece is a good one, I will say any Judge who moves toward “governs best governs least” moves in the right direction.

Robin Shellow, a criminal defense attorney in Milwaukee, says she has seen a growing concern among judges over the federalization of street crime.

Shellow says she has represented dozens of youths who were convicted of gun crimes and sent to prison for life.

“I think that has got to weigh heavily on judges who have been around for a long time and who are saying there’s got to be a better way,” she says.

    Not that I have anything against the guy but finally these athletes might start to get it….You CAN’T just do anything you want and get away with it. If I get caught with a gun, I would have to do time too.
